Jammu, Mar 20: The Health department is reportedly working as per the whims and fancies of a senior pharmacist, for whose adjustment in his favorite hospital Gandhi Nagar, department issued order in contempt of High Court by giving him complete charge of Gynae theater, which was also in violation of guidelines.
As per documents in possession of Early Times, the Jammu and Kashmir High Court on15/3/2017, stayed an order issued by Health department on 13/3/2017, which was issued in violation of High Court order dated 29/7/2016 passed by HC in SWP number 1546/2016.
The story begun in the month of July 2016, when Medical Superintendent Gandhi Nagar hospital issued an order on 25/7/2016 according to which Pawan Kumar Gupta, Senior Pharmacist was directed to take over the complete charge of Gynae Operation theater from Jaswinder Singh senior OT technician.
The order was issued as per directions of higher authorities but it was beyond comprehension as despite availability of a senior Operation Theater technician in hospital, why complete charge of Operation theater was given to a senior pharmacist, for which he was not entitled as per rules?.
The guidelines pertaining to functions of senior pharmacist reads, "In district hospital senior pharmacist shall assist the supervisory pharmacist in discharge of his duties and Incharge Dispensing section".
The order of 25/7/2016 was challenged in High Court, which passed a judgment dated 30th July 2016, in which HC stayed the order of Health department and had also asked reasons from Director Health and Medical Superintendent Gandhi Nagar hospital as why repeated orders of transfer/adjustment of Pawan Kumar G
It seems that the pharmacist is calling all shots in Health department and he got orders as per his whims and fancies and despite repeated transfers to other districts hospitals, he managed to remain in Gandhi Nagar hospital.

As per documents, Pawan Kumar has worked in Gandhi Nagar hospital for the last over two decades of service from 1994 to 1997, then 1998 to 2001, then from 2001 to 2003 then 2003 to 2017.
The political clout of Pawan Kumar could be well gauged from fact that after HC directions, the Health department saw availability of senior technician in hospital as roadblock for adjustment of Pawan Kumar in Gandhi Nagar hospital. "To remove that roadblock, finally on 13/3/2017, the Director Health transferred senior theater technician Jaswinder Singh from Gandhi Nagar hospital to GH Sarwal", the order reads.
Finally on 15/3/2017, the department once again got opportunity to adjust their blue-eyed by issuing an order giving compete charge of Gynae theater to Pawan Kumar in view of transfer of Jaswinder Singh.
The department was so blind in issuing orders that it was in complete oblivion that High Court had stayed their previous order and they had issued the order in contempt of High Court. The High Court once again stayed the order of 13/3/2017 issued by Health department and observed that the order was issued in violation of HC order dated 29/7/2016.
"It seems that the pharmacist is calling all shots in Health department and he got orders as per his whims and fancies and despite repeated transfers to other districts hospitals, he managed to retain posting in Gandhi Nagar hospital. It is also beyond imagination as what is the interest of pharmacist to get posting as incharge operation theater, for which he got a technician transferred from GN hospital", sources said.
