Gair Mumkin Khud case: PHE Secy tenders unconditional apology

Jammu, Apr 19: In the Gair Mumkin Khud case, in which high court had directed to frame a water policy, PHE secretary Sourabh Bhagat today tendered an uncondional apology for not being present in the court yesterday.
Upon this, a division bench directed him to appear on next date of hearing and come with concrete measures for framing Water Policy under section 4 of J&K Water Regulation and Management Act, 2010.
The petitioner's counsel submitted that the high court had passed a judgment on February 12, 2016, directing the government, including contemner Sourab Bhagat and others, to frame a Water Policy within two months. He submitted that more than an year had lapsed but the state had yet not complied with the HC order.
The court had directed the Bhagat to appear before the court, but he had filed an application, submitting that he was in Delhi in connection with some official work. On this, the counsel filed an affidavit, submitting that he was in Jammu and was attending to his official work and had filed a false affidavit. The court took a serious note of it and directed Bhagat to appear in person before the court today with his boarding pass.
The court today took him to task, but senior AAG and deputy AG explained that he was in Delhi and had arrived only yesterday.
The bench took a strong note of non-appearance of the PHE commissioner in court and not complying with the judgment dated February 12, 2016 and delaying implementation for the last one year, two months and five days.
