Rape accused sentenced to 8-year imprisonment

Jammu, May 18: Principal Sessions Judge, Kathua, Vinod Chatterji Koul has awarded eight years imprisonment to a rape accused while acquitting three others.
The court convicted Mohammad Ayaz, son of Bashir Ahmad of Lohai, Morha Sarhali, near Billawar, and acquitted Zarina Begum, Hanifa Begum and Mohammad Hussain as it found no sufficient evidence to prove charges against them.
According to prosecution case, the matter was brought to the notice of police by the victim's father on April 13, 2014. In his complaint, he had alleged that his daughter (17) had been kidnapped by Mohammad Ayaz with the help of Mohammad Hussain and Javid Ahmad, sons of Bashir Ahmad, Rashidi Begum, Mohammad Jabbar, son of Mohammad Hanief, and Mohammad Hafiz, son of Abdullah, all residents of Lohai.
The judge, after hearing the two sides, directed that Ayaz would undergo imprisonment for eight years. He also imposed a fine of Rs 50,000 on him under section 376 of RPC and said in case of default in payment of fine, he would undergo a further imprisonment for one year. "He shall also undergo imprisonment for three years and pay a fine of Rs 3,000 under section 363 of RPC and in case of default in payment of fine, he shall undergo a further imprisonment of three months. He shall also undergo imprisonment for one year and pay a fine of Rs 1,000 under section 344 of RPC and in case of default in payment of fine, he shall undergo a further imprisonment for one month. However, all sentences shall run concurrently," he directed.
The fine, if deposited, would be given to the victim as compensation, the judge said.
