Minibus driver gets 1 month jail for accident

Jammu, May 19: Special railway magistrate, (sub-judge), Jammu, today awarded one month simple imprisonment to a minibus driver for causing accident due to rash and negligent driving.
Minibus driver Puran Chand Sharma of Kathar Manwal had been booked by Nagrota police under sections 279, 337 and 338 of RPC.
On March 25, 2010, Sidhra police post received an information that a minibus (JK02AL/7064), which was being driven in a rash and negligent manner by its driver, had met with an accident at Sra Morh about 4.45 pm, resulting in injuries commuters who were admitted to GMCH here.
The minibus was on its way from Bajalta to Kanchargal. The driver had fled the spot. Cops had then rushed to the spot and registered a case under sections 279 and 337 of RPC.
"The accused is convicted of negligent driving under section 279 of RPC. He is also convicted of causing hurt by a negligent act under section 337 of RPC and causing grievous hurt by doing a negligent act punishable under 338 of RPC. Keeping in view the long drawn trial in the case, the accused having no previous conviction, his family background, age and other relevant factors, a lenient view is taken in awarding him punishment," the judge said.
For offence punishable under section 279 of RPC, he is sentenced to one month simple imprisonment with a fine of Rs 1,000, one month simple imprisonment with a fine of Rs 500 under section 337 of RPC and one month simple imprisonment with a fine of Rs 500 under section 338 of RPC. The imprisonment awarded to the accused, in all the three offences, shall run concurrently and in default of payment of fine, he has to undergo a further one month simple imprisonment. Warrant of imprisonment be drawn accordingly, and sent to the superintendent of district jail, Amphalla," the judge said and directed him to execute the sentence awarded to the accused under law and report compliance.
