Jammu, May 19: With Raj Bhawan unable to make a difference, sportsmen are asking will Chief Justice of Jammu and Kashmir High Court (JKHC) take suo-motto cognizance of the functioning of Jammu and Kashmir Olympic Association (JKOA), seek an account of its activities and force it to adhere to the rules and regulations of the Indian Olympic association (IAO)?
Youth, Service and Sports Department when it was working under Governor N.N.Vohra's administrative council had vide letter dated March 3, 2016 asked the then Secretary, Sports Council to constitute an Adhoc body and hold fresh elections as per the rules and regulations. But the present General Secretary Ashutosh who has affixed Professor with his name went to the court and got the orders of the administrative council stayed.
And since then, he and a Vice-President of PDP have been running the council for the 42nd year in a row. Association was formed in 1975 and got provisional affiliation with the Indian Olympic Association in 1976 which was later confirmed. JKOA is also recognized by the J&K State Sports Council. Sources said that Ashutosh has toured almost half of the world on the name of the association which he has been heading allegedly illegally.
International sport stars are eagerly waiting to see if the Chief Justice of Jammu and Kashmir High Court Justice Badar Durrez Aalam seeks an account of the activities of Jammu and Kashmir Olympic Association (JKOA) which has 23 affiliated sports associations. They point towards the constitution of the Indian Olympic Association (IOA) and say that both the President and General Secretary have never adhered to this constitution. They have violated the rules and regulations.
Despite being in-eligible for both the positions of President and General Secretary, the two have managed to remain in-charge of the Olympic association of Jammu and Kashmir. The constitution of Indian Olympic Association (IOA) stipulates that no member shall hold a post of Office Bearer, as defined in Rule XIV upon attaining the age of superannuation as prescribed in the Statutes of the International Olympic Committee (IOC).
And the IOC charter says that any IOC member ceases to be a member at the end of the calendar year during which he reaches the age of 70. However, neither Sharma believes in relinquishing the office of the Jammu and Kashmir Olympic Association (J&KOA) nor the President JKOA feels the needs to adhere to the constitution of the Indian Olympic association. Ashutosh has been holding the office for more than 36 years now and none is ready to question him as to why he should not relinquish the office of the General Secretary. Sportsmen seek to know why the court should not set-up a commission on the lines of Lodha Panel to address mess in the Jammu and Kashmir Olympic Association (J&KOA).
IOA constitution stipulates that no members shall hold the post of President for more than three consecutive terms or twelve years, whichever is less. While the constitution of IOA maintains that no member shall hold the post of Secretary General or Treasurer for more than two consecutive terms or eight years, whichever is less, but can contest for the post of President after completion of two terms without a cooling off period.
However, Ashutosh Sharma is seemingly the lifetime General Secretary of Jammu and Kashmir Olympic Association (J&KOA). Sources told Early Times that the duo have not allowed creation of district units. They added that the non-existence of district units is to ensure the PDP leader and Ashutosh Sharma continue to rule over Jammu and Kashmir Olympic Association. Brazenness of Ashutosh reflects from the fact that he has turned his home into the office of JKOA and the same has been accepted by Indian Olympic Association without raising any question.
According to a report, the last elections which were held in a meeting of the Association at Amar Singh Club on February 17, 2016 had resulted in Jammu and Kashmir Sports Council (JKSC) withdrawing recognition of the association and the then administration of Governor N.N. Vohra seeking fresh elections. After the elections, it had come to fore that observers from Jammu and Kashmir State Sports Council were simply a frill or an ornament attached to the meeting with no role to play and all the things were set as per the plan of the office bearers
It has come to the knowledge of the Governor that elections had been in an illegal manner, in violation of all the norms of Government of India, Ministry of Youth Affairs and Sports, Indian Olympic Association (IAO) and J&K State Sports Council, apart from high profile Lodha Commission Report, which debars members over 70 years of age to be part of any Association and also debars any member from being elected president for more than three consecutive terms and other office bearers for more than two consecutive terms.
All the four observers from the State Sports Council were neither allowed to be introduced with the members nor were allowed to throw light on the guidelines and norms prescribed for electing office bearers of any Association.
