Jammu, Aug 18: Reprimanding the government for contempt of its previous order, the High Court has ordered construction of a road in Poonch as per sanctioned plan.
According to sources, the Pradhan Mantri Gram Sadak Yojana (PMGSY) had diverted (realigned) road from its original design, besides providing compensation to those whose land was not acquired for the road project.
"Learned counsel for the petitioner contends that the respondents (Commissioner-cum-Secretary to Govt. Revenue Department, Deputy Commissioner, Poonch, SDM Mendhar, XEn and AEE PMGSY Poonch, Tehsildar Mendhar) are constructing the road from Kotian to Gulhota under PMGSY division Mendhar in Poonch district, in violation of the alignment approved by the central government as per the recommendation of the technical experts as also in violation of the order by this court in respect of the matter in issue", the court said in its order dated 11/08/2017. The respondents were directed to ensure construction of the road strictly in accordance with the sanctioned plan and amendment, if any, to the sanctioned plan as has been duly approved.
A local resident, Manzoor Hussain had filed writ petition in court for change of road alignment in 2015. After hearing the parties the Division Bench dismissed the petition in April 2016 and directed the executing agency to construct the road from its original design. Last month, sources said, the district administration started construction of the road in presence of senior officials of various departments. But the officials disobeyed the court order and constructed road in the land of poor people whose land was not acquired in original design. Now the road was constructed 50 meters away from the actual design. "In 375 meters stretch of the road, the acquired land belongs to eight people who had availed the compensation also, but the road was constructed away from the acquired land," sources added.
