Jammu, Sept 19: As Jammu Municipal Corporation (JMC) failed to provide copy of rejection order of a building permission to an information seeker, the Chief Information Commissioner (CIC) has directed the Public Information Officer (PIO) of JMC who is also the Senior Town Planner to provide this information to the applicant. In addition to it the PIO / Senior Town Planner has been issued a penalty show cause notice on the direction of CIC under section 17 of J&K RTI Act 2009.
Details available with Early Times reveal that one Arun Kumar, S/o. Late Krishan Chander, R/O H.No. 35, Malhotra Street, Jammu while exercising his right to information filed RTI application with PIO, JMC, Jammu on 06.03.2017 sought to know, whether the building permission case submitted by him vide receipt No. 1558-61/B/S/16 had been rejected by BOCA; If the said case had been rejected, copy of order whereby the Building Permission (BP) had been so rejected, be provided to him.
Aggrieved by the non-receipt of information from the office of PIO, he filed First Appeal on 10.04.2017 with JMC Commissioner who is also the First Appellate Authority (FAA) . Again getting no relief from Commissioner / FAA JMC , Arun Kumar finally approached the State Information Commission (SIC) by filing 2nd appeal against the PIO / FAA of Jammu Municipal Corporation (JMC).
The PIO submitted that the building permission case of the appellant was placed before the BOCA Committee and the same had been rejected by the said Committee. However, the formal order was yet to be issued in this regard.
CIC in his order observed, "In view of the submissions of the PIO and the statements of the counsel for the appellant, PIO/Sh. R.K. Tutoo, Senior Town Planner, JMC, Jammu is directed to issue the rejection order as per the laid down procedure and norms and convey the same to the appellant/applicant concerned. The PIO is also directed to show cause, why penalty proceedings may not be initiated against him under section 17 of the Act for giving contradictory reply to the appellant. His reply, alongwith relevant proof, should reach the Commission within 30 days from the date of receipt of this order. With these directions the second appeal is disposed of".
