HC grants pre arrest bail to ex Principal of GDC Udhampur for offences corruption

JAMMU, Nov 22: The Jammu and Kashmir High Court has granted anticipatory bail to Ex-principal of GDC Udhampur for offences under prevention of corruption Act.
Petitioner, Dr. Nutan Kumar Restura, had been booked by the State Vigilance Organization, Jammu in FIR No. 11/2017 for offences under section 5(1) (d) read with 5 (2) of the Jammu and Kashmir Prevention of Corruption Action, Samvat, 2006 for offence having committed financial irregularities, while posted as Principal, Government Degree College, Udhampur in the year 2010-12. The FIR has been registered on 30.03.2017.
Petitioner had sought anticipatory bail under section 497-A Cr.P.C following which the court granted him interim anticipatory bail.
Justice Janak Raj Kotwal after hearing the counsel for the parties observed that as per objections filed on behalf of the respondent, grant of anticipatory bail to the petitioner is objected only on the ground that he is highly influential person and is still in service and there is every apprehension and likelihood of his winning over the witnesses and destroying/tampering the important record/evidences pertaining to the case. It is noticed in context of the contention raised on behalf of the respondent that matter relates to the years, 2010-12 when the petitioner was posted as Principal, Government Degree College, Udhampur.
Justice Kotwal held that it is not stated, nor it can be believed, that the petitioner in any manner has control or reach to the documents relevant to the case nor there is any substance in contention that he will win over the witnesses. With this view Justice Kotwal held that the court find no sufficient ground for refusing the confirmation of the interim bail granted to the petitioner.
