Rape victim accuses Police of not registering FIR

Udhampur, July 17: A rape victim from Chenani area of district Udhampur has alleged that Police refused to register FIR against the accused.
The rape victim while Talking to Early Times said that she was married on 7th of July 2018 and while at her in law's place, her husband's brother entered her room and raped her. She said that when she narrated the incident to her husband, he did not pay any heed to the incident, following which she told the entire incident to her sister's husband, who took her to Chenani Police station. She alleged that the Munshi refused to register my complaint and to get her medical examination done.
Kuldeep Singh brother in law of rape victim said that he came to know about the incident and took his sister in law to the Police station but they refused to register the FIR. "We went to the senior officers, but they also did not do anything. Interestingly, after getting an order from the court, the police have not registered the case" he added.
In the Year 2013 union Home Minister has issued an Strict instructions to all the states and UT's that Refusing to register an FIR on jurisdictional ground could now cost a policeman a year in jail. The home minister in the year 2013 told the states and Union Territories to clearly instruct all police stations that failure to register FIR on receipt of information about any cognisable offence will invite prosecution of the duty police officer under IPC Section 166A (government official disobeying law) which will invite imprisonment up to one year. MHA also told the states and UTs that policemen should be sensitized to respond to complaints with alacrity, whether it is from man or woman, and must apprehend the accused immediately after the complaint, as it adversely impacts the victim and there is tendency of persons committing crimes to slip away when there is delay on extraneous grounds like jurisdiction.
When contacted, SSP udhampur Rayeez Bhat said that factual report as called by the Court in the matter has already been submitted.
