JAMMU, Aug 26: Wonder Kashmir hullabaloo to influence Apex Court hearing petitions seeking 35-A abrogation. It's a gone case, say legal luminaries. State leaders failing to value visionary instrument 'state subject' of Maharaja Hari Singh to not just protect identity but build J&K state interests need to blame themselves rather PM Modi, said SS Bijral, former IGP and BJP state spokesperson.
What Maharaja Hari Singh envisioned nearly a century ago, Narinder Modi then CM Gujarat on same analogy grabbed Tata Motor's Nano factory at Singur, West Bengal when Mamta Banerjee TMC launching 'Save Farm Land' movement, denied land to Tatas in West Bengal. Bijral said rich Gujarat got richer with car hub at the cost of W. Bengal.
Lamenting state leadership side stepping values of revolutionary 'State Subject' legislation aimed to save identities of Ladakhis, Kashmiris, Dogras, Baltis and others besides providing for economic development of state, usurped Article 35-A, renamed it 'Permanent Resident' to protect religious majoritarianism. Its time people awaken to self centred leaders design, source of their sufferings and turmoil, and be watchful of their interests.
Pointing Maharaja State Subject Act had categorized Class III and Class IV certificate too providing for state subject through 'Riyatanama' and 'Ijazatanama' and registering companies for state subject to protect state's financial stability, Bijral said using Article 35-A empowering state legislature to define Permanent Residents and providing special rights and privileges to those permanent residents, adopted Class I and Class II provisions of Maharaja 1927 Act, deleting Class III and Class IV categories.
The result is that Safai Karamcharis brought from other states on promise of settlement and West Pak refugees settled here after partition are non residents with no citizen rights, trampling human rights. Spokesperson said 35 A is root cause of state's backwardness.
