Harsh questions validity of indefinite assembly suspension, new order over CDF

Jammu, Aug 28: Maintaining that suspension of Assembly for indefinite period was bad in law, Harsh Dev Singh JKNPP Chairman and Former Minister today filed RTIs with the Governor's Secretariat an State Law Deptt seeking the logistics for prolonging the period of suspension notwithstanding the failure of all political parties to muster the requisite strength despite lapse of more than 70 days.
Describing the continued Assembly suspension as violative of constitutional guarantees besides being violative of set precedents, Singh questioned in his RTI application, the provisions of law permitting the continuation of suspended assembly especially in a situation when none of the political parties has come forward with requisite numbers or staked claim to from the govt. Pointing towards the dissolution of Assembly ordered within a weeks' time following the fall of Ghulam Nabi Azad Govt in 2008 during UPA rule, Mr. Singh sought justification and cogent reasons for prolongation of assembly suspension with no initiative appearing to have been taken either to revive the same or dissolve it. Under what provision could Governor Rule and political rule be allowed to run concurrently? Questioned Harsh in his RTI. Elucidating, he divulged that during Governor's rule all powers of political govt get vested in the Governor with Ministers and MLAs getting divested of their authority and role. It was strange however that even during the Governor Rule the political rule was allowed to continue simultaneously, with MLAs allowed to operate fiancés, CDF and draw their full salaries with all allowances, TA, DA, free fuel and appurtenant facilities. Seeking details of total funds including all emoluments and allowances released in favour of members of suspended assembly, after June 19, Singh said the huge grants withdrawn by the said members amounted to organized loot of the state's resources.
