Early Times Report
Jammu, Sept 3: West Pakistani Hindu Refugee Front (WPHRF) held a meeting of prominent persons of West Pakistani Refugees (WPRs) and others at Village Laswara (Bishnah).
The meeting was held to discuss the issue of postponement of hearing by the Supreme Court (SC) on Article 35A. He also addressed the points raised by the WPRs relating to cash relief of Rs 5.5 Lakh to WPRs as announced by the Centre Govt and issue of Identity Certificate meant for them.
While speaking on postponement of hearing on Article 35A by the Supreme Court, he made it clear that the SC has to hear both the parties who are opposing and defending Art 35A to adjudicate whether it has been included in the Constitution of India through an unconstitutional process or otherwise.
If the 3 Judge Bench where the case is presently pending for hearing, observe any constitutional dispute in its inclusion, the case will then be referred to the 5 Judge Bench of the SC, who is competent to give any verdict on any constitutional dispute. Only thereafter any action if deemed necessary will be taken by the Centre Govt. in accordance with the provisions contain innthe constitution, which may take a considerable time. He further added that few Rallies organized in Jammu for abrogation of Art 35A and on the other hand few protests and bands organized in Kashmir and some part of Jammu in support of Art 35A are unfortunate.
He expressed his concern and on such rallies and protests as these have created an atmosphere to disturb communal harmony in the Region. He also expressed that such rallies will also invite delay in any decision by the SC on the Issue and desired that since the case is under examination with the SC any rally or protest should be treated as Contempt of Court and defaulters should be dealt with severely for causing disturbance in peace of the region.
While speaking on Cash Relief of 5.5 lakhs to 5764 WPR families only as announced by the Centre Govt, he express that this relief is to compensate the domestic loss or loss of residential property left behind in the Pakistan by them at the time of migration to Jammu & Kashmir hiding themselves due to threat of lives by communal riots there on partition of India during 1947.
