Services Selection Board, Transport Deptt show 'disrespect' to HC Judge's order
Allow deficient candidates to join, deserving left out of selection

SRINAGAR, Sep 9: The government departments in the state have of late been showing 'disrespect' to the judiciary by not implementing the orders or directions issued by the court from time to time with respect to service matters.
The Transport Department and Services Selection Board virtually showed disdain to the order of a judge of High Court issued last year vis-à-vis selection of candidates for the posts of motor vehicle inspectors. The selection had been challenged by deserving candidates who were left out of the fray.
On September 26, 2017, Justice Ramalingam Sudhakar of Jammu & Kashmir issued directions that due consideration should be given to the merit of the allegation. The allegation mentioned refers to the contention of aggrieved candidates that they were left out despite meeting the criteria set out by the appointing authority. "Upon receipt of such representation/complaint along with a copy of this order, the respondent number 2 shall accord consideration as to the merit of the allegation. If there is any substance, then the authority shall deal with the issue strictly as per law," wrote Justice Sudhakar in the order.
He further wrote that if the rights of the private respondents are likely to be affected, then it is necessary that they be put on notice so as to avoid allegation of violation of principles of natural justice. He directed the authority to expedite the inquiry if the complaint has merit and only if there is any substance. The respondent number 2 in the case was Chairman Services Selection Board. The judge opined that the petitioners are given a liberty to make a detailed representation to the Chairman Services Selection Board pointing out the error that they allege so as to enable the authority to consider the same on its own merits.
The aggrieved candidates approached the office of Chairman Services Selection Board at Srinagar with the representation on September 28, 2017. The petitioners pointed out towards the flaws in the selection list and it was expected that necessary action would be taken, but that was not to be. Instead of listening to the plea of petitioners the selected candidates were allowed to join the duties.
It was on February 16, 2013 that Services Selection Board advertised eight posts of Motor Vehicle Inspectors under the item number 033. It was after a gap of more than four years on August 28, 2017 that the selection list of motor vehicle inspectors was made public through press.
Selection of Raja Omer who is at serial number one of the selection list in the open merit category has been challenged on the basis that he has shown that he has completed his Bachelor of Engineering (Mechanical) in 2013 with the result being declared on February 19, 2013. The candidate has provided the experience certificate issued by General Manager, Mechanical Jammu & Kashmir State Road Transport Corporation and the date of the same March 30, 2016.
Abid Hussan Matoo's selection that stood at serial number two in the selection list at serial number two in the open merit category has been challenged on the basis of conflicting date of birth. In the date of birth issued by State Board of School Education his date of birth has been shown as April 28, 1984 with the same being shown as April 24, 1983 in the driving license. Overwriting has been found on the page seven of his driving license and it has also been challenged.
Selection of Rahil Anjum Bhat has been challenged since he is not authorized to drive heavy passenger motor vehicle (a condition set out at the time of applying for the post). He has shown experience as working for Srinagar Municipal Corporation for two years, but the period of engagement has not been mentioned in the experience certificate.
Mohammad Owais Qadri's selection has been challenged on the ground that he has shown that he was simultaneously pursuing his engineering degree from Punjab Technical University and gaining experience while working at Fairdeal Motors and Workshop, Srinagar. He has shown that he passed his final year of engineering degree in 2012 with the experience certificate of Fairdeal Motors and Workshop showing that he worked as mechanic between June 2011 and February 2013.
The aggrieved candidates have also moved a representation with the Governor of Jammu & Kashmir with the hope that justice will be done. Despite fulfilling the requisite criteria the highly qualified engineers have been virtually ditched by Services Selection Board and Transport Department.
