HC stays recruitment notification for LC posts
File for formulation of service rules gathering dust

Jammu, Sept 17: The recent recruitment notification issued by Legislative Council for various posts has been stayed by the High Court of Jammu and Kashmir after strong resentment shown by employees demanding formulation of service rules for promotions and recruitments.
It is pertinent to mention here that Early Times has already published stories regarding this controversial recruitment notification in its September edition particularly on the qualification sought in various posts which caused resentment among the aspirants.
Sources told Early Times that the employees took the step to get stayed the notification in the wake of gross violations in recruitments in past wherein umpteen cases of backdoor appointments have come to light. They stressed that service rules should be framed first. Astonishingly, the file for formulation of service rules for LA and LC has been gathering dust in Law Department for the last 10 years.
"In the absence of the service rules, it has been observed that the parameters for recruitments are generally tailored to adjust blue eyed. The recent notification was one such example, wherein for the post of Translator, Reporter, the candidates with computer degrees were preferred despite the fact that the job of above said posts required no such particular qualification though basic computer knowledge is sufficient but due to lack of service rules, officials at the helms of the affair kept such qualification in requirement ostensibly to favour their favourites," they alleged.
Moreover, the a private agency was hired to the conduct written exams for these posts which also drew flak despite the fact that the agency remained in controversy in KVIB recruitment exams last year, they informed.
Pertinently, Jammu and Kashmir Legislative Council and JK Legislative Assembly Rules 1959 are being followed and have not been amended till date. The file for the formulation of service rules has been lying pending for the vetting in Law Department since 2007.
"During previous government of NC-Congress, the then Law Minister Mir Saifullah had directed the ARI and Law Department to formulate the service rules after reports of gross backdoor appointment cases. Thereafter, ARI Department forwarded the file to Law Department for its concurrence but till date nothing has been done in this connection. They further informed that the incumbent as well as previous Speaker Legislative Assembly of BJP held several meetings and sent letters to the Law Department for expediting the process for framing service rules for the both houses. Even Governor' intervention was sought to clear the way for the service rules file. If sources are to be believed, the Law Department wants to keep its supremacy on the both houses due to which it has been delaying the process to clear the file, despite the fact that Chairman LC and Speaker LA are the authorities of their respective houses.
Sources further said that as per past practice, the recruitment was being done in both houses by Chairman and Speaker to their kitchen boys and this is for the first time in the history that the posts are being advertised. Even few years ago few matriculates retired as Special Secretaries or Additional Secretaries while degrees of most of the employees are fake and even invalid who are enjoying posting of Deputy Secretaries, Special Secretaries or Under Secretaries or Section Officers (SOs). If sources are to be believed some junior Librarians managed to get the rank of Section Officers and even Deputy Secretaries.
