Kishtwar, Apr 25: As the Block Development Officer (BDO) who is also the designated Public Information Officer (PIO) pleaded that photocopying of official record would divert lot of official resources the State Information Commission (SIC) in its direction has directed the information seeker (RTI applicant) to undertake inspection of the official record the information of which was sought under Right to Information (RTI) Act.
Details available with Early Times reveal that an RTI application was filed by one Chander Kant, a resident of village Ohili Kuntwara, block Drabshalla, district Kishtwar in the office of Assistant Commissioner Development (ACD) Kishtwar on 18.09.2018 seeking information on developmental works executed by local block office.
After getting no response Chanderkant fled First Appeal on 29.10.2018. Again feeling aggrieved, Chanderkant filed Second appeal before the SIC on 17.12.2018 praying therein that the respondents may be directed to furnish the requisite information.
The appeal came up for hearing before the SIC on 03.04.2019. The appellant as well as the PIO/BDO, Drabshalla were present during the hearing.
The PIO submitted that the appellant has sought huge information relating to all works executed in Block Drabshalla during the last three years.
PIO told SIC that copying of such huge and voluminous information would not only divert the resources of the office disproportionately but would require the office to shut down routine works for collection and preparation of the information.
With the agreement of the parties, the appeal was disposed of by SIC with a direction to the appellant Chander Kant to visit the office of PIO/BDO, Drabshalla on 25.04.2019 during office hours and have inspection of records pertaining to the queries raised by him in his RTI application. The PIO/BDO, Drabshalla was also directed to be present on the above said date in his office and facilitate inspection of records by the appellant by showing all the relevant files to him.
"In case after having such inspection, the appellant seeks certain copies of documents/records, the same shall be provided by the PIO to the appellant within a period of one week from the date of inspection of records.
In case the PIO fails to facilitate the inspection of records, the appellant shall be at liberty to file a complaint before the Commission," reads the SIC order.
