PIL highlighting deficiency of sports facilities in J&K
DB directs UOI to file affidavit

JAMMU, Sept 18: In a Public Interest Litigation (PIL) highlighting deficiency of sports facilities in the State, A Division Bench of State High Court Comprising Chief Justice Gita Mittal and Justice Rashid Ali Dar observed that status report has been filed on behalf of respondent No 1, Union of India through Ministry of Youth Affairs and Sports dated 16th September 2019. A perusal thereof would show that the respondent No 1 has largely denied the responsibilities for facilitating development of sports in the State.
DB further observed that in para 2 III a reference is made to a special Package for J&K approved and announced as on 7th November 2015.In para 2 III b ii. (page 286) a reference is made to release of Rs. 14.30 crore vide sanction order dated 16th July 2018.
DB further observed that the several issues noted by us in a several orders have not even been referred to. The lack of facilities noted by us as also the responsibility to ensure that all sports disciplines are properly developed in the State deserves more serious attention. The responsibility of the Centre which dispenses funds to disable sports bodies cannot be denied in this manner.
Upon this DB directed that this matter be placed at the highest level in the concerned Ministry. Let an affidavit with regard to the issue flagged up by us in the more serious attention. The responsibility of the Centre which dispenses funds to disable sports bodies cannot be denied in this manner.

Let an affidavit with regard to the issue flagged up by us in the several orders hereinbefore be filed by the Secretary, Ministry of Youth Affairs and Sports, Government of India. DB further directed that before filing the affidavit, the same shall be placed before the Minister concerned.
Upon this time is sought by Shah Aamir, learned AAG to file a further status report on behalf of the Department of Youth Services and Sports Council. Let the same be done before the next date. Certain areas, say for instance, possibility of creating specially of dedicated water sports and winter sports in the State is not even begun.
