Jammu, Oct 4: In a significant order Justice Dhiraj Singh Thakur of J&K High Court, Jammu Wing has directed maintenance of Status-quo with regard to the building DPS (Junior Wing) Kathua comprised in Khasra No. 2465/308 measuring 13 Kanals and 3 Marlas owned and possessed by Ch. Lal Singh (Ex-Forest Minister), Shanti Devi (mother of Ch. Lal Singh), Mohan Singh, Sohan Singh, Rajinder Singh alias Babbi (all brothers of Ch. Lal Singh), Radha Rani (sister of Ch. Lal Singh), situated in Village Taraf Tajwal, Ward No. 4, Tehsil & District Kathua.
After hearing Senior Advocate K.S. Johal with Advocates Karman Singh Johal and Supreet Singh Johal, in a writ petition filed by Ex-Forest Minister Ch. Lal Singh and 9 family members including his wife Kanta Andotra and sons Divya Suraj Pratap Singh and Divya Chander Pratap Singh, Justice Dhiraj Singh Thakur issued directions to the Deputy Commissioner, Kathua, President Municipal Council, Kathua and SSP Kathua and others that in case any action has to be taken on the premise that the land over which the petitioners' have raised construction is in their un-authorised occupation, notice be issued to the petitioners and reasonable opportunity of being heard be also granted to them.
Justice Dhiraj Singh Thakur further directed that in case any order adverse to the petitioners is passed, the same shall not be implemented for a period of one week from the date of receipt of the order with a view to enable the petitioners to challenge the same.
Senior Advocate K.S. Johal with Advocate Karman Singh Johal vehemently argued that Deputy Commissioner, Kathua and other officers of District Administration are likely to demolish the building over which DPS, Junior Wing, Kathua has been constructed by Ex-Forest Minister Ch. Lal Singh and other members of his family because of political vendetta and the Senior Counsel further submitted that the other buildings belonging to the Ex-Minister and his family members have since been demolished without service of any notice and without affording any opportunity of being heard to them.
Senior Advocate K.S. Johal further submitted that the land over which the DPS (Junior Wing) Kathua has been erected is actually owned by Ch. Lal Singh and his brothers/sister and it is not the State land.
After considering the submissions of Senior Advocate K.S. Johal with Advocate Karman Singh Johal, Justice Dhiraj Singh Thakur of J&K High Court, Jammu Wing has directed maintenance of Status-quo with regard to the building DPS (Junior Wing) Kathua comprised in Khasra No. 2465/308 measuring 13 Kanals and 3 Marlas owned and possessed by Ch. Lal Singh (Ex-Forest Minister), Shanti Devi (mother of Ch. Lal Singh), Mohan Singh, Sohan Singh, Rajinder Singh alias Babbi (all brothers of Ch. Lal Singh), Radha Rani (sister of Ch.
