No brick kiln shall operate around 8 kms to Srinagar: DB to State

JAMMU, Oct 19: A Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Rashid Ali Dar, directed State to ensure that no brick kiln is permitted to operate within 8 km from the centre of the run way of the Srinagar Airport.
When the PIL came-up for hearing, DB observed that our attention is drawn by Tahir Majid Shamsi, ASGI to the order dated 6th October 2017 wherein the Court in para 8 has recorded that the operators of brick kiln have already indicated that they would voluntarily shut down their brick kilns from 15th November 2017 till 31st March 2018. The Court had also noted that the possibility of re-location would also be considered in view of the technical requirements given by the Indian Air Force of not having a brick kiln within an 8 km radius from the central point of the runway.
It has also been submitted in the reply filed by the Indian Air Force to this application. Amongst the reasons, it is stated that the smoke released by the kilns is a serious hazardous to health. The Indian Air Force has pointed out that on account of smog/smoke emitting from the brick kilns, low visibility conditions are caused which leads to cancellation/delay of flights and amongst other adversities and reference is also made to the stipulations contained in para 7 (d) of Chapter 17 of IAP 3309 (Manual of Air Traffic Service). In support of the submissions that bring kiln are continuing to operate in violation of the above conditions, the Air Force has placed photographs on record. DB further observed that Anil Bhan, counsel appearing for respondent No 2 that M/s Nipman Foundation has conducted the disability access audit of the Jammu Airport, however, the report is awaited. Bhan, has also informed this Court that initially M/s Nipman Foundation has informed the Airport Authority that it would conduct the disability access audit of the Airports at Srinagar and Leh, but has not submitted that because of the weather conditions, they would conduct the disability access audit in March 2020.
Upon this DB directed Airport Authority communicate with M/s Nipman Foundation and inform them that the airports remain functional even during the winter months and there would be no justifiable reasons for postponing the disability access audit for this long period of over five months which would result in delaying measures being taken to make these airports accessible. Bhan submits that one opportunity may be given to discuss the matter with the said organization once again. (JNF)
