JK Govt has no concrete transfer policy, present one a mockery

SRINAGAR, Feb 7: There is no concrete transfer policy with government of Jammu and Kashmir and the same has become a mockery now whereas the blue eyed persons are given choicest postings and are transferred at the door steps.
At least there is the minimum tenure of a government employee on a post shall be two years and a maximum of three years, however it is altogether different here in the union territory of Jammu Kashmir, said sources.
"Be it a doctor or any government employee who don't have an access to the corridors of politicians or bureaucrats, are transferred from south to north and like east to west, but the influential employees gets transferred over a single phone call," sources informed to early Times.
Recently Health and Medical Education department issued a transfer and posting list of some of the doctors.
While citing as an example of recently made transfers , the transfer list was issued vide order no 103-JK (HME) of 2020 Dated 31/01/2020, about which sources said that, just after 11 months of posting, Dr Sajada Tak Gynecologist who is at s.no 10, was transferred from SDH Pattan to DH Budgam.
Dr Ibrar Bashir, MD SPM Medical Officer at s.no 16: according to the same order vide no: 103-JK (HME) of 2020 Dated 31/01/2020, was transferred from Police Hospital to PHC Sonmarag. Just after 3 days the same doctor, Dr Ibrar Bashir was transferred back to police hospital at s.no 6 vide order no 112-JK (HME) 2020 Dated: 03/02/2020.
However sources further said that, the list goes long and they questioned that is this the transfer policy about which the government is talking.
While referring the previous orders with regard to transfer policy, they mentioned that under cabinet decision No. 156/12/2010 Dated 27.7.2010. Government Order No. 861-GAD of 2010 Dated: 28.07.2010
The order reads that the departments shall make transfers of government employees strictly in conformity with the Transfer Policy, and in the annexure to Government Order No.861-GAD of 2010 dated 28.07.2010
It shall be imperative for all the Government departments to maintain a complete database on transfers/postings of their employees for effective implementation of the transfer policy, reads the order.
It further said that the orders once issued must be strictly complied with and if it is considered that any order requires modification for some compelling reason, it shall be done only after obtaining approval of the next higher authority.
Reversal of transfer orders once made must be a very rare event and to be resorted to only in exceptional cases for which reasons shall be recorded in writing and the minimum tenure of a government employee on a post shall be two years and a maximum of three years.
While as there was a modification by the Jammu and Kashmir delegation of powers act, 2018 (Governor's Act No. 1 of 2018), and in partial modification of notification SRO 307 dated 11th July, 2018, read with notification SRO 281 dated 23rd June, 2018, the Governor has made some amendments and so on and so forth, sources quoted about the order.
