DSE Jammu victimizing aggrieved to save its skin

MENDHAR, Feb 22: In a glaring example of sheer discrimination and victimization at the hands of School Education Department, a woman, who was singled out as teacher around 30 years ago, has been still struggling to get her job back but her fight for justice sees no end.
Shameem Akhatar daughter of Mohammad Sadiq resident of Topa Salwah tehsil Mendhar district Poonch was shunted out for no reason of her by the then ZEO Harni Mendhar of district Poonch due to some personal confrontation.
Narrating her tale of woes, Shameem said that the then District Education Officer (DEO) Poonch M Y Kohli had appointed 2000 teachers across the district in 1989-90 and she was among them but on 10-5-1991 all appointments were cancelled by the then DEO Poonch Satwant Chopra.
She further said that a petition was filed in the court by the terminated teachers under one language and one dispatch number. In 1998 the double Bench Court gave verdict under LPA- 151- 1992 in favour of petitioners by directing department to reinstate them.
"The then Chief Education Officer (CEO) Poonch Sunrinder Singh Sahani reinstated all and issued order in 1998 to all ZEOs to comply the order but the then ZEO Harni Mendhar Mohammad Bashir didn't reinstated me on some flimsy grounds," she said further adding that ZEO Harni did it deliberately to debar her. Later the CEO was transferred.
Meanwhile, Director School Education (DSE) Jammu also issued order for her joining 2-1-2000 DSEJ/Writ/ 1620/10/0/02 but CEO Poonch in 2001 had filed an objection giving contradictory statements, but Court rejected the statement submitted by department and again asked the department to issue afresh order in favour of petitioner but CEO didn't comply with the court order.
Misfortunes continue to follow her, meanwhile Shameem lost her brother, Mohammad Naseer, who was found dead in Rajouri and on 11-9-2002 militants burnt her house due to which she lost all her documents, which totally shattered her and the entire family, a FIR No. 79/2002 was also lodged in this connection. She re-collected all documents but again one more mishappening took place with her as she again lost her another brother. She again filed a Writ SWP1167, 2016 and the decision came on 27-11-2017. The judge was so furious to see the deliberate negligence of DSE Jammu, that he immediately called the DSE and asked him to present in person before the court.
When DSE Jammu appeared before the court, he admitted the mistake and assured that he would call the petitioner and the concerned ZEO at his office for her joining on a particular date of 23-12-17 but when petitioner reached the office of DSE Jammu, he was not present in his office.
She was again given another date of 6-02-2018 to meet at DSE by the concerned ZEO. The date of meeting was fixed by ZEO deliberately to avoid meeting as he was going to retire on 31-1-2018 and case remained unsettled.
Meanwhile DSE Jammu was also retired, new DSE was also given representation, the lawyer of petitioner also went to DSE Jammu but nothing happened. The petitioner filed an RTI with CEO Poonch and ZEO Poonch, who gave records which were submitted with DSE but nothing was done.
The incumbent Director School Education Jammu Anuradha Gupta constituted a committee comprised of CEO Rajouri and Principal DIET Poonch, who also gave verdict in the favour Shameem Akhtar. DSE Jammu constituted another committee, headed by JK Soodan SIE Jammu, which also gave decision in favour of victim. Unhappy and unsatisfied with the committee reports, DSE Jammu wrote Commissioner Secretary Education that petitioner had criminal background and the case of her reinstatement is not permissible as a result Commissioner Secretary ordered to file FIR against petitioner as well as the department.
The CEO Poonch showed reluctance to lodge FIR against petitioner and wrote Crime Branch requesting it to lodge FIR, if she was found guilty. CB called petitioner on February 2020 to present her case. CB also directed CEO Poonch to bring all annexure, enclosures in this connection. CB didn't file FIR against petitioner and started investigation and till date she has been struggling to get justice
