Domicile Law –A Cruel Joke with J&K youth

It is so strange and sad that when the country is battling and fighting the deadly coronavirus, the BJP government took this as an opportunity to notify a domicile law regarding the jobs. The new domicile law announced by the centre is nothing short of a cruel joke with the educated unemployed youth of Jammu and Kashmir union territory .The new law provides reservation to the local youth in the government jobs only for class fourth. It also provides that other non gazetted and gazetted jobs above class fourth will be open to all Indians provided their parents have resided for 15 years in Jammu and Kashmir. Thus in effect all jobs in Jammu and Kashmir except the class fourth will be open to all Indians including the domiciles of the UT. The law in question deprives the locals youth of J&K of their rights and dues. It robes them of the government and semi-government jobs. The law adds salt to the injury already inflicted on the population particularly the youth of the UT. It is understood that the domicile law regarding the land rights will be announced very soon and there will be four categories of residential, industrial, agricultural and commercial in the proposed law. In fact the new domicile law regarding the job rights is an assault .on the rights of the Jammu and Kashmir youth. As soon as the notification regarding the new law was issued, all mainstream national and regional political parties opposed the law and expressed their displeasure and said that the hopes and aspirations’ of Jammu and Kashmir people have dashed to the ground. People especially the youth of J&K had great hopes on the central government and they expected justice from the central government but unfortunately this was not the case. NC, PDP, JKAP, JKNPP and CPIM and last but not the least the congress have expressed their resentment on the new domicile act. All these parties in one voice have opposed the law.NC Vice President and form chief minister Omer Abudullah has criticised the domicile law and bracketed it as ill timed. According to the NC the law was announced at a time when the whole country is fighting coronavirus and the government has timed it so that the opposition parties are unable to protest on the roads. The announcement of the reservation only for class fourth jobs is no less than a insult to the youth of Jammu and Kashmir. Since other non gazetted and gazetted posts will be open for other Indians and the only criteria is that their parents should have served for ten years in the UT or the erstwhile state. The new law will give further boost to unemployment in the UT. It will be very difficult for the jand k youth to compete with the other youth of the country as they have good educational facilities and also coaching facilities as well and in such a situation it will be very difficult for the local youth to compete with the others. Thus in effect the local youth will be deprived of their rights. The very definition of the domicile is defective and against the rights and dues of the J&K youth and robs them of their rights and hence is unacceptable. Even the children of the all India officers who have served for ten years in J&K are also eligible to apply for the jobs. According to the new domicile law others who can apply for the jobs are all India officers, officials of PS undertakings and autonomous bodies of central government and public sector banks who served and serve in J&K for ten years. This definition of the domicile is defective and contrary to the interests of the local youth. Omer Abdullah former CM and vice president of NC has remarked that the law is so hallow that even the new political party created with the blessings of Delhi has also criticised the new domicile law as they were forced to oppose the law.PDP has said that the rules will create massive problems for the local youth of the Jammu and Kashmir. According to them the centres manipulation of the law will further alienate the Kashmiris’ and this is thus unacceptable. According to the political parties none of the protections promised where in the new rules and thus the opposition. Altaf bukhari the founder of the Jammu and Kashmir Apni party who was lobbying in Delhi for the domicile law was forced to oppose the law. The new law deprives the people of the UT of their constitutional rights. The new definition of the domicile is humiliating and insulting and is thus unacceptable. Anyway the central government should review the domicile law for the good of the people
