‘Road blacktopped forcefully on private land without compensation’
Victim family who gave three generations to defence services, seeks justice

JAMMU, June 29: Three generations of our family served the Indian security forces, we are disciplined and law abiding citizens, but yet we went through worst ever time of our life, when the Public Works Department in presence of Magistrate and Police, forcefully carried out blacktopping works of a road on our private land, says R S Sumbria, son of Late Lt Colonel Puran Singh Sumbria.
Narrating his ordeal, a retired Bank Officer, R S Sumbria said when his family objected the illegal works on their land by government agencies, the Police picked-up us and kept in custody.
“Three generation of our family served Indian Security Forces, including my grandfather Brigadier Chattar Singh Sumbria, who was in State Forces of pre-1947, my father Lt Colonel Puran Singh Sumbria, my two brothers were in armed forces including K S Sumbria as Commander in Indian Navy and Prakash Singh Sumbria, an Indian Air Force officer, who died in an aircraft crash,” he said, adding every Indian stand with our forces, why injustice is being meted out to this family of defence personnel.
“Police arrested me, my wife, my son and daughter-in-law for protesting against unlawful act of a government agency, it is very unfortunate that my four years old granddaughter remained alone in the house”, he said.
Sumbria said that the Magistrate, Naib Tehsildar, Ravinder Sharma from Rakh Bahu Nyabat of Bahu Tehsil, who supervised assassination of our genuine case, had himself sent our case to JDA for compensation.
He said that four decade long struggle to get compensation for our land was started by my father late, Lt Colonel P S Sumbria.
“Even, division Bench (DB) of J&K High Court, headed by the then Chief Justice M. Ramakrishna and Justice B.A. Khan, hearing the appeal filed by my father Lt Colonel Puran Singh Sumbria, son of Brigadier Chattar Singh Sumbria and Hony Lieutenant Baij Nath, son of Lt Bhagat Ram, had disposed of the appeal by directing State of J&K, JDA, Director Land Management JDA, Deputy Commissioner Jammu and Negotiation Committee for Land Acquisition Cases through DC Jammu to conclude negotiation and finalize the report of the Negotiation Committee to be headed by the Divisional Commissioner after affording the appellants a reasonable opportunity of being heard”, said R S Sumbria.
“I had represented my case to the then Dy Chief Minister, who was also the Minister for PDD and Housing and Urban Development Department through representation on 20th January 2017.
The Board of Directors of JDA in their 78th meeting held on 15th of February of same year decided that a committee of officers will determine the land owned by Lt Col P S Sumbria which has come under the road and JDA shall acquire the land for the purpose under the Land Acquisition Act for payment of compensation to him and submit the report to Administrative Department".
The JDA on 27th May 2017 placed an indent to the District Collector (DC) Jammu for acquisition of land and the same was forwarded by DC Jammu to the Collector JDA.
The necessary revenue documents were got prepared by the Collector JDA to the DC Jammu on 23rd August 2017 for issuing necessary declaration under Section 6 and 7 of the State Land Acquisition Act by the competent authority.
The said case file was submitted by DC Jammu to the Divisional Commissioner Jammu next year on 28th of March and the Divisional Commissioner Jammu further submitted the case to the Financial Commissioner Revenue J&K Jammu. There was found a mismatch of land measurement submitted and a clarification in this regard was sought out.
The Collector JDA after getting the report of Tehsildar JDA requested ACR Jammu vide to direct Tehsildar Bahu to furnish fresh revenue papers for 1 Kanal and the same were submitted back to the Collector JDA after authentication by the DLM JDA.
The Collector JDA again sent the file to the DLM JDA for attestation of the quantum of land and since then the file has not been sent back to the Collector JDA for further acquisition proceedings.
“More than three years have passed since my represented its case and yet my legitimate claim for compensation has not been settled” Sumbria stated.
SHO, Bahu Fort Bishnesh Kumar when contacted said that Police was called by the Magistrate to maintain law and order. “PWD carried out blacktopping works on stretch of road in the presence of the Magistrate, the family tried to interrupt the works, so they were taken into custody by the Police”, he added.
Magistrate, Naib Tehsildar, Bahu Ravinder Sharma could not be contacted for his comment.
