SRINAGAR, July 12: The orders passed by the people at helm regarding ban on re-employment or re-engagement of retired government officers and officials were being trampled and there has been no difference even during the present dispensation led by Lieutenant Governor Girish Chander Murmu.
The latest example in this regard is the contractual engagement of Ghulam Nabi Khanday. Khanday who retired as Principal Private Secretary in the office of Divisional Commissioner Kashmir on May 31, 2020 was showered the benefit of contractual engagement in the same office from June 1, 2020 for a period of three months.
The proposal for re-engagement of Khanday was mooted in the month of May when Divisional Commissioner Kashmir, Pandurang Kondbarao Pole wrote to letter to Farooq Ahmad Lone, then Secretary General Administration Department (GAD) in this regard. The Divisional Commissioner vouched for extension of six months in the service of Khanday.
“Mr. Ghulam Nabi Khanday, Principal Private Secretary with undersigned is retiring on superannuation from government services on 31-05-2020. He has very good experience of dealing with situations by working on many sensitive and important postings in different capacities,” wrote the Divisional Commissioner Kashmir under correspondence number DivComm/PS/212 dated 7-5-2020.
In the correspondence the Divisional Commissioner Kashmir had written that he has recently joined as Divisional Commissioner and found Khanday working with dedication, honesty and hard work. In the present scenario his services are immensely required by the undersigned and as such I shall be grateful if extension of 06 months is granted in his services, he wrote.
The General Administration Department while paying heed to the proposal of Divisional Commissioner Kashmir granted sanction to the contractual engagement of Khanday for a period of three months from the afternoon of May 31, 2020 (date of his retirement). This means that this official did not sit at his home for a single day and he continues to be a part and parcel of the system in place.
“Sanction is accorded to the contractual engagement of Ghulam Nabi Khanday, at present, Principal Private Secretary in the office of Divisional Commissioner, Kashmir for a period of 03 months beyond the date of his retirement on superannuation i.e., 31.05.2020 AN, on the following terms and conditions,” reads the government order 579-JK (GAD) of 2020 dated 20-05-2020 issued by the GAD.
The terms and conditions as set out in the order are that the engagement would be contractual with effect from June 1, 2020 with the official getting the last drawn salary minus pension and commuted portion of pension and the leave/HRA/TA would be admissible to him as being given to the temporary government employees.
It would be in place to mention here that an explanation was sought from Khanday by former Divisional Commissioner, Kashmir, Baseer Khan after he remained absent from duties without seeking permission from the higher ups. He was asked to be present and explain his position failing which action would have been taken against him.
“The Divisional Commissioner, Kashmir called for you at 10.15 am, however it was given to understand that you have not reported for duties. Further, it was intimated that you have not submitted any leave or even informed anybody about the delay. Now, therefore, I am directed to seek an explanation from you for remaining absent without leave because you will also explain as to why you should not be marked absent from duties,” wrote Dr. Tasaduq Hussain Mir, Additional Commissioner, Kashmir under correspondence number DivCom/NA2-PF/933/2019 dated 14-10-2019.
Pertinent to mention here that former government of Peoples Democratic Party & Bharatiya Janta Party had banned all re-engagement and contractual engagement of the retired officials in the erstwhile state of Jammu & Kashmir. Former Governor Narendra Nath Vohra had also advocated for the same while banning all such engagements.
